Portfolite ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our portfolio creation service ("Service"). By using Portfolite, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

1.1 Information You Provide Directly

When you create a Portfolite account, we collect the following information:

  • Full Name: Collected during account creation and may be displayed publicly on your portfolio.
  • Email Address: Used for account authentication, service communications, and account recovery. Your email address is not publicly displayed and remains private.
  • Workspace Subdomain: The custom subdomain you choose (e.g., your-name.portfolite.com) becomes your public portfolio URL and is publicly accessible.
  • Password: Encrypted and stored securely. We never have access to your plaintext password and it is never shared or displayed.
  • Portfolio Content: All content you upload to your portfolio, including resumes, images, work samples, text descriptions, links, and any other materials, are publicly accessible by default at your portfolio URL.

1.2 Information Collected Automatically

When you access our Service, we automatically collect certain technical information:

  • Usage Data: Information about how you interact with the Service, including pages viewed, features used, time spent on pages, and navigation paths.
  • Device Information: IP address, browser type and version, operating system, device type, and unique device identifiers.
  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to track activity on our Service and store certain information. See Section 8 for more details.
  • Log Data: Server logs that include your IP address, browser type, pages visited, time and date of visits, time spent on pages, and other diagnostic data.

1.3 Information from Third Parties

We do not currently collect information about you from third-party sources. If this changes, we will update this Privacy Policy accordingly.

2. What Information Is Public vs. Private

2.1 Publicly Accessible Information

The following information is public and can be viewed by anyone:

  • Your full name (as entered during account creation)
  • Your portfolio URL/subdomain (e.g., yourname.portfolite.com)
  • All portfolio content you upload, including resumes, images, work samples, project descriptions, text, links, and any other materials

Your portfolio is accessible to anyone with the URL and may be indexed by search engines.

2.2 Private Information

The following information is private and not publicly displayed:

  • Your email address
  • Your password (stored encrypted)
  • Your IP address and device information
  • Your usage data and analytics
  • Payment information (if applicable in the future; we do not currently process payments)

3. How We Use Your Information

  • To Provide and Maintain the Service: Create, host, and display your public portfolio, manage your account, and provide customer support.
  • To Communicate with You: Send service-related announcements, updates, security alerts, and administrative messages. Promotional communications are sent only if you opt in.
  • To Improve Our Service: Understand how users interact with the Service, identify bugs, analyze trends, and improve features and user experience.
  • For Security and Fraud Prevention: Detect, prevent, and address technical issues, security incidents, fraud, and illegal activities.
  • To Comply with Legal Obligations: Respond to laws, regulations, legal processes, or enforceable governmental requests.
  • For Analytics: Monitor and analyze usage patterns, track portfolio views, and generate aggregate statistics that do not identify individuals.
  • To Enforce Our Terms: Enforce our Terms and Conditions, including investigating potential violations.

4. How We Share Your Information

  • Public Portfolio Content: Your name, portfolio URL, and all uploaded portfolio content are publicly accessible by design.
  • Service Providers: Shared with third-party service providers who perform services on our behalf (e.g., hosting, email, analytics, and support). These providers are obligated to protect your information and use it only for specified purposes.
  • Legal Compliance: Disclosed when required by law, court order, subpoena, or other legal process, or when necessary to protect rights, safety, investigate fraud, or respond to government requests.
  • Business Transfers: If Portfolite is involved in a merger, acquisition, sale of assets, bankruptcy, or similar transaction, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Service of any change in ownership or use of your personal information.
  • With Your Consent: Shared with third parties when you explicitly consent to such sharing.
  • Aggregated or De-Identified Data: Shared in aggregated or de-identified form that cannot reasonably be used to identify you.

5. Data Storage and Security

5.1 Data Storage Location

Your information is stored on secure servers provided by our cloud hosting provider (currently Vercel, backed by AWS infrastructure) located in the United States. By using the Service, you consent to the transfer and storage of your information in this location.

5.2 Security Measures

We implement industry-standard security measures to protect your information, including:

  • Encryption of data in transit using SSL/TLS
  • Encrypted password storage using secure hashing algorithms
  • Regular security audits and monitoring
  • Access controls and authentication mechanisms
  • Secure backup procedures

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account password.

6. Data Retention

  • Active Accounts: We retain your account information and portfolio content for as long as your account remains active.
  • Account Deletion: If you request account deletion, we will delete your personal information within 30 days, except where retention is required for legal, regulatory, or legitimate business purposes (such as resolving disputes or enforcing agreements).
  • Backups: Some information may remain in backup systems for a limited period after deletion.
  • Search Engine Caching: After account deletion, we will make reasonable efforts to request removal of your portfolio from search engine caches, but cannot control when search engines remove cached content.

7. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information:

  • Access: Request access to the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete personal information.
  • Deletion: Request deletion of your personal information, subject to legal exceptions.
  • Data Portability: Request a copy of your personal information in a structured, commonly used, and machine-readable format.
  • Withdraw Consent: Withdraw consent where processing is based on consent.
  • Opt-Out of Marketing: Opt out of promotional communications at any time.
  • Object to Processing: Object to certain types of processing of your personal information.

8. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track activity on our Service and store certain information. Cookies are small data files stored on your device.

8.1 Types of Cookies We Use

  • Essential Cookies: Required for the Service to function properly, including authentication and security features. These cannot be disabled.
  • Functional Cookies: Remember your preferences and settings to enhance your experience.
  • Analytics Cookies: Help us understand how visitors interact with our Service by collecting and reporting information anonymously (e.g., Google Analytics).
  • Advertising Cookies: We do not currently use advertising cookies. If this changes, we will update this policy.

10. Children's Privacy

Portfolite is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us immediately at support@portfolite.com. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will take steps to delete that information promptly.

11. International Data Transfers

Your information may be transferred to, stored, and processed in countries other than your country of residence, where data protection laws may differ. By using the Service, you consent to the transfer of your information to our servers and those of our service providers. We take appropriate safeguards to ensure that your personal information remains protected in accordance with this Privacy Policy.

12. California Privacy Rights (CCPA)

  • Right to Know: Request information about the personal information we have collected about you, including the categories of information, sources, purposes, and third parties with whom we share it.
  • Right to Delete: Request deletion of your personal information, subject to certain exceptions.
  • Right to Opt-Out of Sale: We do not sell your personal information.

13. European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have certain rights under the General Data Protection Regulation (GDPR):

  • Legal Basis for Processing: We process your personal information based on your consent, performance of a contract with you, compliance with legal obligations, or our legitimate interests.
  • Data Protection Rights: You have the rights listed in Section 7, including the right to lodge a complaint with a supervisory authority.

14. Canadian Privacy Rights (PIPEDA)

If you are a Canadian resident, your personal information is protected under the Personal Information Protection and Electronic Documents Act (PIPEDA). You have the right to access your personal information, request corrections, and file a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated. We comply with PIPEDA's principles regarding the collection, use, and disclosure of personal information.
